I recently saw a comparison video to how American and British lawyers make arguments in cases. In America, it’s considered normal to throw everything and the kitchen sink at a legal case. You make every argument you can make, you come at it from every possible angle because you don’t know which one the jury will agree with. You also don’t know which arguments the other side will even try to defend against, so they may not be able to counter so many different approaches.
In the UK, you generally pick your strongest arguments and you avoid weak ones for fear of being perceived as dishonest if you make weak or implausible arguments.
In the American tradition, then, I can absolutely imagine someone thinking that SOME jurors could agree you should have noticed a blinking light, so throw it in the mix.
