Free and fair market is that anyone can participate and no one can acquire coins in a way that is unavailable to other participants.
Giving yourself free coins when other's could not give themselves free coins is not a free and fair market.
Mining coins after announcing the start of bitcoin and only mining when anyone else in the world can is a free and fair market.

Satoshi only mined when it was publicly available.
