AA has outside counsel and in-house counsel. Outside counsel’s job is to most effectively litigate the matter at hand, subject to decisions that the client may choose to make for non-legal reasons. There is zero chance that outside counsel did not provide their Answer to AA’s in-house counsel for review prior to it being filed. Someone at AA approved it, and it was filed.

If anyone made a “mistake” it was AA’s in-house counsel for not foreseeing the possibility that boilerplate, standard affirmative defense language could be manipulated into a faux media scandal. That’s not outside counsels fault; they drafted the best pleading they could, which is what they should have done.

If someone at AA wanted to submit a marginally less-effective pleading for PR purposes - they had the opportunity  to do so.

They whiffed, no anticipating this issue. And now AA is backtracking.
