They didn't use the Securities ETF approval framework however It's still legal for the them to approve the ETF without specifically recognizing ETH as a commodity. Since ETH has both qualities of a security and a commodity, the most logical next step would be for the them to expand and write new definitions/categories that are meant specifically for crypto assets.
