That's so reductive of rape, I honestly can't believe you're trying to equate the two.

Morally speaking rape is worst than vandalism, ie the damage done to the building.

That being said, as I pointed out, the legal problem with hate crime is that it must be proven out of any reasonable doubt.

Between you and me, yes, it's likely that hate was the motive but that's not legal evidence, hence why the prosecutor didn't raise the charge yet.

Furthermore, still legally speaking, attempted rape and rape are two different things. Still, the context is slightly different, but anyway.
