The limited amount of data that’s out there shows that two people in the cab leads to more distractions. Almost all locomotives are equipped with alerters and dead man switches anyways so if the engineer doesn’t make an action for a full minute, the train will go into emergency shut down. The big issue though is the lack of data and the lack of a SBREFA analysis. SBREFA is federally required to analyze the financial impacts of new regulations on small businesses. Most railroads are short lines - approximately 650 nationwide - and many of them run one man crews and can’t afford to hire more crew members. FRA didn’t do a SBREFA analysis and lied about how many railroads operate single man crews (they said it was roughly 20 total nationwide, and based on ASLRRA’s data, it’s closer to 400-500) so the regulation isn’t legal. It wouldn’t be so bad if they cared out exemptions for short lines, which operate extremely differently than Class I’s, but they didn’t. Which is why AAR and ASLRRA are suing the government over this rule.
