Not quite. At this point, OpenAI's rhetoric and conduct could trigger a congressional investigation, and it seems like it should.
My point is more about the implications for the company, technology, and their shareholders.
Let's say Congress investigates and concludes that OpenAI has, indeed, developed AGI or they're so close as to be tantamount to AGI (which appears to be the case by the way). If OpenAI's own experts are to be believed, one would think that the government should immediately appropriate the technology as being a potentially catastrophic threat to the US, modern civilization, and the human race at large.
You see? It's tough to imagine shareholders being OK with Sam Altman's governance overall the last 12-18 months, and things only seem to be getting worse (see, e.g., his "her").
Anyway the implications go on and on, and we'll see how things roll out. There's a very good chance that all of this will go under the radar because it's an election year - but it doesn't seem like it should if AGI > nuclear weapons.
Edit: I'd trust the NSA et al., a thousand times over rather than the latest rando tech bro CEO. They break the law but they're a known entity at least. No CEO should be in charge of something more threatening than nuclear weapons, especially yet another rando tech bro guru from Silicon Valley facade'ing as your college roommate. Give me a break.
