I agree that it does not capture individuals, but it will likely capture those buying and selling (from their own money and crypto) because they are "effecting transactions in securities for the account of others" by basically being market makers (converting a spread).

That captures BISQ, ROBO Sats or any P2P exchange/software. Even /r/cash4cash is going to get caught up in that. It will also destroy the lightning network because those nodes "effect transactions in securities for the account of others".

The only real way around it would be to create open source software that does it for free.
