If those lawyers are doing their job correctly they are discussing defense strategy with outside counsel and reviewing the pleadings outside counsel drafts before they are filed. House counsel have professional responsibility to the corporation that mandates they consider the overall well-being of the company even if the affirmative defense may be standard practice.
In the case at hand, given AA has now instructed outside counsel to withdraw the affirmative defense, it is clear that AA did not need to file a specific affirmative defense saying the plaintiff should have seen the recording device in order to defend the case. It is not as though AA is conceding defeat and settling the case.
You are completely mis-understanding the job of house counsel if you cannot see failure to prevent this from happening is bad practice.
