I disagree. The punitative aspect associated with schedule 1 substances has always been the worst part. I don't think it's reasonable to expect under our current politics a perfect solution. I think we're closer to legalization than you think. In the meantime, it's helping to rectify some of the major harm caused by the drug war and criminalization.

I agree that handing it to big business sucks. Again, I don't see how in our political landscape they'd manage legalization. I wish they could.
