I'm reminded of when Obama warned Congress that their proposed law allowing US citizens to sue Saudia Arabia for 9/11 before vetoing that bill followed by a veto override. Then like a day after it passed, Congress realized that exposing the US to similar lawsuits from foreign countries could open a floodgate and suddenly had buyer's remorse and criticized Obama for not better communicating the potential consequences of the law.

Same reason why the US withdrew it's signature and didn't ratify the Rome Statute. Nobody wants to open Pandora's box and put the US at risk of being held liable for war crimes as judged by a third party.

The harsh reality is that the ICC doesn't have any teeth. They pick and choose their battles and if they were remotely capable of being a fair and effective investigative body, there would thousands more cases in front of them -- but complex international relations, alliances, diplomatic immunity, and so on, don't really make it viable to have an international criminal court of any real force or consequence. One of those ideas that's good in principle but falls on its face in practice.
