She has enough of a case to bring this to court and make OAI's life difficult but as a layperson, this sounds far more like business as usual than either the Bette Midler or Tom Waits case. In the Bette Midler case, she was told to do an impersonation and in the Tom Waits case, it seems like they may have had him back away from a complete impersonation but they chose a Tom Waits impersonator to cover a Tom Waits parody song. Impersonation is a conscious decision on the part of the person doing the impersonating so if the actress is just using her voice and has no idea that is what they're going for.

Even if that is the character they want to try and evoke in everyone's mind, there isn't the same potential and intent to deceive as in those cases. It's like saying if I want Arnold Schwarzenegger and he says no, I can't hire an Austrian man with a muscular build if that's what I'm envisioning for the character. If a director wants to get Jesse Eisenberg but he says no, should he be barred from hiring Michael Cera because people think they resemble each other from a distance. I don't think so and I don't think the law says that.
