Because they didn't use her voice. They stated that they used a voice actor that they had been working with since before they contacted Scarlett. How similar is too similar is the question. Would it be an issue if someone used recorded audio from a voice actor that may sound like Scarlett? Is intention the only issue? Is it only an issue if they directed the voice actor to sound like Scarlett or chose her because she sounded like Scarlett? Should they not be allowed to do that? Surely they're allowed to find a voice actor with a vaguely similar voice, right? So we're just drawing a line somewhere of how similar sounding is too similar. It's clear they wanted people to see the similarities to the movie her, but any actual copyright or likeness issue in this case is much less clear.
Of course people have other concerns about the company and the future of AI as a whole, but that's not really the discussion here. Training on copyrighted material or how the company is run are very separate concerns from this.
