Ok wow, so we're now going on the path of sueing people and things based on likeness? So I can't become a model if I look like an already established model? And I can't sell my voice if it sounds like that of an already famous actor or actress? That's like patenting a face or a voice group.
If you listen carefully you will hear that Sky's voice and that of Scarlett are actually quite a bit apart. They have about the same tonation and dynamic and the giggle is a bit similar. It's a very cosy, positive and friendly voice type that is shared by many, many people currently alive. I actually know someone with a very similar voice (and giggle), but because she doesn't speak English you won't make the match so easily.
But there's a reason why Scarlett's voice was casted for Her and that's because Scarlett's voice fits the specs for a helpful, positive, cosy and friendly female person. For the movie Her they could have casted a way cheaper similar voice actress, but they also need some big names to sell the movie and you don't want to put some unknown name next to Joaquin Phoenix marketing wise.
Now if you are going to pick an assistant voice you will want a cosy, positive and friendly voice, so sooner or later you will end up with one that sounds like Scarlett's. Of course people like the voice, that's exactly why Scarlett was casted as a voice actress. But people who never saw the movie Her also liked the Sky voice best, it's just a very nice voice to listen to, but it's a far from unique sounding one.
