You misunderstand. By asking Johansson to do the voice, getting turned down, and going ahead and releasing a voice that is credibly close enough to hers, combined with Altman’s “her” tweet and his last-minute re-ask basically recreates the factual basis for two cases that were both won by the plaintiffs, Bette Midler and Tom Waits, both asked to use or perform a song in an ad, both turned it down, both successfully won cases over soundalikes. OpenAI, at least from what we know, could not have done a better job mirroring the case law precedents around this if they tried.

And secondly; no this doesn’t mean a voice actress is out of a job, it just means that these particular factors mean that OpenAI fucked up. Voice actors have a lot of range and flexibility. You don’t get hired just because “you do a really good ScarJo” lol

In fact, this might be a boon for the voice actress’ career if she can get work voicing characters that ScarJo played on screen for video games or animation, the way Tom Hanks brother gets work. If you do it all legally, you can absolutely get paid to impersonate a specific celebrity voice, and even have that be a major part of your work history.
