If OAI just fed her voice into the model, they're fucked whichever way this goes, and at this point surely jury will agree that this is what OAI did unless they can prove they didn't.

If OAI hired a voice actor and told them to "do a Scarlett Johansson impression", and fed the result into the model, then this likely is the precedent.

If OAI hired a voice actor who just happens to have similar voice, and got the samples for Sky out of her without namedropping Johansson in the process, then I'm pretty sure no, and it would probably go the way of Lohan v.
