Opensource doesn't mean you have the right to hack a running code and exploit people using it. If you are using Firefox and someone steals your credit card information because of a bug on Firefox, is it legal?
Ethereum's mempool is public information. Technically speaking, everybody can exploit it and that's what MEV bots do - including Sandwich bots. The attacker ("Sandwich the ripper" / the 2 MIT brothers) exploited a running program to reveal private information. Whether it is opensource or not is not important: exploiting a software to reveal private information and make money with it is a fraud.
It's sad but it is how it works. And believe me, I would prefer it the other way.
