Not sure if this is a serious or a troll question, but the legal issues between sucking in internet data and training a model are very different from purposefully* copying *Her*.

(*=not saying this is what they were doing, but of course if legal action kicks off, that's what an enterprising lawyer will argue and, maybe, succeed with.)

The former is an unclear and muddy area of law and one where they will almost certainly eventually win (be it through the courts or legislation).

The latter...far more legal risk. But the stakes are also much lower (this is not at all existential to their business model), so this is an area that they will (relatively) happily concede ground.
