Sounds to me like this is a direct participation program of a sort. Investors are essentially loaning out money to the program and the company is using those funds to fulfill their investment objectives. Direct participation programs often buy real estate or stuff like oil or gold. If the company has secured contracts to purchase assets at one price and have secured purchasing agreements to sell those assets to a buyer (or buyers) at a higher price over the next 10 years, and multiple insurance companies have contractually agreed to cover investor’s principal losses should the company managing all of this becomes insolvent, than this explains the guarantee claims. If this is all true…then…The 15% is simply your share of the profits obtained from the underlying investment scheme. The rate of return is probably guaranteed to the extent that profits continue as planned for the duration of the program. And the principal balance is secured by insurance companies, similar in concept to how FDIC works with banks, but that probably has limits. At any rate, I don’t think this is a scam, but I do think the marketing is likely misleading. Or…rather…it’s manipulation and taking advantage of the fact that the general public may not understand this stuff well enough to be candid and straight factual. So they market in ways that’ll catch your attention, like 15% guaranteed for 10 years…and probably saying something about not wanting market losses in your 401k.
